Terms & Conditions

Last updated: 18 April 2025

1. About These Terms

These Terms and Conditions set out the basis on which Krathong Law ("we", "us", "the firm") provides legal services to clients who engage us. By making an enquiry, attending a consultation, or entering into a client engagement, you accept these terms.

We may update these terms from time to time. The version published on our website at the time of your engagement will apply to that engagement. We will draw material changes to your attention.

2. Our Services

Krathong Law is a specialist family law practice based in Chonburi, Thailand. We provide the following services to individuals and families:

The scope of our engagement with you will be set out in a separate client care letter or engagement agreement, which forms part of the contract between us.

3. Engagement and Instructions

We act only on clear instructions from you or your authorised representative. We will confirm our understanding of your instructions in writing at the outset of an engagement and will request clarification where instructions are ambiguous.

You are responsible for the accuracy and completeness of all information and documentation you provide to us. We rely on the information you give us and are not responsible for errors arising from inaccurate or incomplete instructions.

4. Fees and Payment

Our fees are quoted in Thai Baht (฿) and are set out in your engagement letter. Current indicative fees are:

These fees cover the scope described in the engagement letter. Work falling outside that scope may be subject to additional fees, which we will discuss with you in advance.

Payment terms will be specified in the engagement letter. Unless otherwise agreed, invoices are due within fourteen (14) days of issue. We reserve the right to pause work on a matter where payment is overdue.

All fees are exclusive of any disbursements (court fees, translation costs, filing charges, and similar out-of-pocket expenses), which will be itemised separately and invoiced at cost.

5. Confidentiality

All information you share with us in connection with your matter is treated as strictly confidential. We will not disclose it to any third party without your consent, except where we are required to do so by law, court order, or professional obligation.

Our confidentiality obligations continue after the conclusion of any engagement.

6. Professional Standards

We practise in accordance with the rules and ethical obligations of the Lawyers Council of Thailand. Our advocates maintain the professional standards required of registered legal practitioners in Thailand.

We are committed to acting in your best interests and in the best interests of any children affected by the matters we handle. Where we consider that your instructions would not serve those interests, we will advise you honestly and clearly.

7. Limitation of Liability

We take care in the advice and services we provide. However, legal outcomes in family matters depend on many factors outside our control, including the decisions of courts, the conduct of other parties, and changes in applicable law. Nothing in these terms, and nothing we say to you, should be understood as a commitment to any particular outcome.

Our liability to you is limited to direct losses arising from our own negligence or breach of contract. We are not liable for consequential, indirect, or special losses. Our maximum liability in any matter shall not exceed the total fees paid by you in connection with that matter.

Nothing in these terms limits liability for death, personal injury caused by our negligence, or fraud.

8. Intellectual Property

Documents and written materials prepared by us for your matter remain the intellectual property of Krathong Law until our fees in respect of that work have been paid in full. Upon payment, ownership of those materials passes to you for the purpose of your matter.

You may not reproduce, distribute, or publish materials prepared by us without our prior written consent.

9. Termination

You may terminate our engagement at any time by written notice. You will remain liable for fees in respect of work carried out up to the date of termination, and for any disbursements already incurred.

We may withdraw from an engagement in limited circumstances, including where you provide instructions we consider unethical, where there is a conflict of interest that cannot be managed, or where payment obligations remain unmet after reasonable notice. We will give reasonable advance notice wherever possible and will seek to minimise disruption to your matter.

10. Complaints

If you are dissatisfied with any aspect of our service, we encourage you to raise the matter with us directly in the first instance. We take complaints seriously and aim to respond promptly and constructively.

If a complaint cannot be resolved internally, you may refer the matter to the Lawyers Council of Thailand, the professional body with oversight of registered legal practitioners in Thailand.

11. Governing Law and Jurisdiction

These terms are governed by the laws of the Kingdom of Thailand. Any disputes arising under or in connection with these terms that cannot be resolved between the parties will be subject to the jurisdiction of the Thai courts.
